Terms of Service

These Terms of Service ("Terms") govern your access to and use of 360 Flow and related websites and services (the "Service"), provided by FireCoding Group LLC ("Firecoding", "we", "us", or "our"). By using the Service, you agree to these Terms.
1. The Service
360flow is a communications and coordination platform for service businesses, including card-based boards, a unified customer view, calling, messaging, email, file sharing, automations, and related features. We may update or improve the Service over time.
2. Accounts & eligibility
You must provide accurate information, keep your credentials secure, and be authorized to bind your organization. You are responsible for activity that occurs under your account and for your users’ and guests’ compliance with these Terms.
3. Acceptable use & no-spam policy
We enforce a strict no-spam policy to protect deliverability and the reputation of every customer’s numbers and domains. You agree that you will:
- Only contact people who have given you the required consent to be contacted.
- Honor opt-out requests promptly, including SMS "STOP" and email unsubscribe requests.
- Not send unlawful, deceptive, harassing, or unsolicited bulk messages, and not use purchased or scraped contact lists.
- Comply with all applicable laws and industry rules, including the TCPA, CAN-SPAM, FCC regulations, A2P 10DLC registration requirements, and CTIA messaging principles.
4. Customer communications & compliance
You are the sender of communications you originate through the Service and are responsible for obtaining and documenting the consent required for your calls, texts, and emails. We provide compliance-supporting features — such as STIR/SHAKEN-attested calling and A2P 10DLC registration — but you remain responsible for lawful use.
Automated voice agents provided through the Service are inbound-only answering agents; the Service is not to be used to place automated outbound or robocalls.
5. Fees & billing
Paid plans are billed according to the pricing in effect when you subscribe (for example, Basic at $89/month and Business at $249/month, with Starter free and Enterprise priced by quote). Fees are billed to the organization in advance and are non-refundable except where required by law. We may change pricing on a going-forward basis with notice.
6. Third-party integrations
The Service can connect to third-party services (such as Gmail and, in the future, Housecall Pro). Your use of those services is governed by their terms, and we are not responsible for third-party services. You authorize us to exchange data with an integration only to the extent you enable it.
7. Healthcare & HIPAA
Unless you have entered into a Business Associate Agreement (BAA) with us and your workspace is provisioned for HIPAA, you agree not to use the Service to transmit Protected Health Information (PHI). Contact us to enable a HIPAA-compliant configuration.
8. Intellectual property
We and our licensors own the Service, including its software, design, and trademarks. You retain ownership of the content and data you submit ("Customer Data"), and you grant us the limited rights needed to operate and provide the Service to you.
9. Confidentiality & data protection
We handle Customer Data in accordance with our Privacy Policy. Each organization’s data is isolated at the database layer, and we apply administrative, technical, and physical safeguards designed to protect it.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law, including communications-compliance laws.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms — including our no-spam policy — or as needed to protect the Service and its users. Upon termination, your right to use the Service ends, and we will make Customer Data available for export for a reasonable period where practical.
14. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules, and the parties consent to the exclusive jurisdiction of the state and federal courts located in Ohio.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date, and continued use of the Service after changes take effect constitutes acceptance.
